First, our company is French, so the French version of these terms and conditions (Conditions d'Utilisation) is our primary source. If there is any confusion regarding the translation, please contact us, and we will explain further.
These conditions provide a guide for the commercial relations established between Mondizen and the customer and whether the customer is an individual or a legal entity. All purchases made on the Mondizen website imply customer agreement that these conditions are accepted unconditionally. Accepting this agreement is confirmed by the customer during the checkout process when the customer checks the checkbox labelled, "I agree with the terms of service" .
In exchange for the customer’s purchase, Mondizen prepares and sends the purchased items to the customer.
The terms and conditions of use as written here prevail over all other conditions, whether particular or general, not written, and/or agreed to by Mondizen.

Mondizen reserves the right to modify these conditions at any time. In the case of such modification, the conditions of use applied to a transaction will be those in force at the time of that order.
Mondizen offers the products listed in its catalog on its Internet site.
The photos are as accurate as possible, but are only illustrations of how the product appears and sometimes can present the product differently from its reality(for example colors might be slightly different). Mondizen is not responsible for such small modifications in the text of product packaging. The images of its products are not contractual. All product descriptions in the catalog are edited by Mondizen.

Mondizen reserves the right to change any offering at any time whether that offering relates to products or services.
Any product offering and service is valid for the duration of its publication/posting on the Mondizen Internet site.
Mondizen is in no way responsible for the contents of packages sent through the Customized Order Service if the error is due to a mistake made by the company Mondizen has contracted with to fulfill the order.
All products are sold based on the available stock held by Mondizen suppliers.
In the case of a stock shortage, Mondizen reserves the right to remove that product from its catalog. If an order with our supplier has to be made, the preparation of your order can then be delayed by 72 hours.
If a customer has ordered a product, and there is a shortage of stock, Mondizen will reimburse the customer or suggest a similar product. The customer can choose whether to accept Mondizen's suggestion.
Product prices indicated on the website are in Euros or US Dollars and do not include transport/shipping costs. Shipping or transport prices include full preparation and processing of the order.
The prices of our services are also displayed in Euros or US Dollars.
On the Mondizen homepage under the link “Shipping” is a table that summarizes all delivery costs. This information is relevant for most orders.
The exact delivery cost for each order is always presented before you finalize that order. The delivery costs are based on destination, weight, and dimensions of the order package.
When completing your order, a summary is presented giving a "Total" price. This price includes all delivery costs and order preparation. By validating the order, the customer accepts the cost of preparation and also the cost of delivery for that order.
The final price is also noted in an email that confirms the order. The email is sent by Mondizen after the order is completed.
Prices listed by Mondizen do not include customs duty or any taxes applied by the destination country. These additional customs duties or taxes, where applicable, must be covered by the customer.
Mondizen reserves the right to modify its prices at any time and in particular indicate price increases received from suppliers or transporters. In the case of a price change for a product or service, the price paid by the client will remain the price paid at the time of the order.
Your order is paid for by your credit card when that order is validated. Mondizen sends an order only after having received that payment from the customer.
Mondizen reserves the right to verify the identity of the buyer by reimbursing a small amount of the purchase price. Then Mondizen will ask the buyer to confirm the exact amount that has been credited to his account. In case of refusal or inability of the buyer to provide this amount, Mondizen reserves the right to cancel the sale and will refund the money collected minus the amount of the transfer audit.
When, the customer enters an address for delivery. Mondizen is not responsible for any errors ( delays, deliveries not completed, delivery to a 3rd party, return of an order) that arise due to an error in delivery information. In the case where an order is returned to Mondizen, a new attempt at delivery will not be made unless the customer pays the costs of this new delivery. If a delivery is lost and there is an error in the address or the name on the delivery, Mondizen will not reimburse the customer for a wrong shipping address or a package going to the wrong person.
Mondizen’s goal is to deliver each order within 14-20 days from the date of that order. This time frame is given as an indication of the typical delay. If the customer has not received an order within 50 days, the customer can cancel the order and receive total reimbursement for that order.
However, Mondizen cannot be held responsible for delays causes by a force majeure (circumstances beyond our control) like a flood or strike or plane crash, etc., that delays delivery beyond 30 days or results in damage or loss of an order.
Your package will be prepared in 48-72 hours (working days). However, if we had to order from our suppliers, this would require an additional 48 to 72 hours (working days).
Prices listed by Mondizen do not include customs duty or any taxes applied by the destination country. These additional customs duties or taxes, where applicable, must be covered by the customer. The customer must take possession of your order before being able to return it.
We draw the customer's attention to the baby milk and baby food deliveries or other essential products. We recommend that you always have enough stock to cope with the international delivery delays. Regarding orders of big quantities, additional documents may be asked by the customs. Getting these documents may lead to additional fees and / or delivery delays.
All Mondizen customers have 14 days from the date of delivery to return an order or part of the order. To be eligible for return, the product(s) must not have been used and must be in its original packaging. All return shipping costs for return are customer's responsibility.
Due to certain delays associated with international shipping, a customer cannot return food products or magazines. All product packaging must be undamaged and unopened to be eligible for a return refund.
The refusal by a client to pay duty or taxes is not considered an acceptable reason for return or refund of the order. The customer must take possession of their order before being able to return it.
The customer can retract within 14 full days an order related to services provided by Mondizen, except in the case where the provision of that service has already begun. When a service is refunded, the customer must notify Mondizen by email, using the "Contact Us" link on the website within 14 days of that order.
When a customer exercises the right of retraction and observes the conditions cited, whether related to a product or service, Mondizen will reimburse the total cost to the customer for that product or service. This reimbursement will be completed within 20 days from the date the returned products are received by Mondizen or notification of the desire to retract a service.
If the contents of a package do not correspond with the details of the submitted order, Mondizen will refund the missing products within 14 days from the date Mondizen is notified by the customer. This refund can only take place if the customer can prove that the item delivered were not the right ones (with photos of their package for example).
It is the customer's responsibility to verify the condition of a package and its contents upon receipt. If a package is damaged, the customer must open and inspect the contents in the presence of the delivery agent. Any damaged goods should be noted on the delivery order to provide due justification to Mondizen. If products are missing or damaged, the customer must contact Mondizen, by email or telephone, within 24 hours of the time of delivery. Mondizen will then refund products that are missing or damaged. If possible, the customer can send photos to Mondizen.
If the customer does not follow this procedure, Mondizen will not reimburse or replace missing or damaged products.
If the products in the package are damaged with no signs of damage to the package, the customer must inform Mondizen within 24 hours of signing for the delivery. Mondizen will then refund the missing products, within 14 days from the date Mondizen was notified by the customer.
If the customer's order has not been delivered after 50 days and that delay is the responsibility of Mondizen (in particular the delivery address provided by the customer was correct and the package was not held by customs in the destination country), Mondizen will inform the customer and refund the order or send a second shipment to be delivered to the customer within 20 days.
By observing the article 1641 of the Code Civil, Mondizen "must uphold the guarantee in relation to any hidden defects of the object sold that render it's usage ineffective"
In the case where an appliance or object is guaranteed, the customer must send the damaged object to Mondizen and Mondizen will reimburse the cost of this purchase.
All returned products must be complete, in good condition and in the original packaging. The return shipping costs are at the customer's charge.
If an object is returned and is incomplete or the packaging is damaged, then at the discretion of Mondizen the object may not be reimbursed.
This sections discusses sales within the context of the Mondizen Clubs. The Mondizen Clubs have the following specific conditions:
All orders are payable after Club orders are placed when the customer receives an email requesting payment. Due to this process, there can be a delay of several days between placing an order and actually paying for that order.
A timeframe of 14 days for shipping begins when Club orders have been paid.
The customer can remove products from his or her cart as long as the order has not yet been validated. Once validated, the customer can add, but cannot remove, products.
This paragraph deals with the general terms and conditions of sale relative to the Multi-shop Service, regarding the following points:
Mondizen cannot be held responsible for distributor stock when orders are placed. If a product is out of stock, the client will be contacted by Mondizen to find a suitable solution for both parties.
Mondizen cannot be held responsible for extended delivery times for products ordered and delivered to their warehouses in France.
Products purchased through the Multi-shop service are sold with a manufacturer’s warranty.
To process and send orders, Mondizen must record certain personal details.
This information is recorded uniquely to allow the customer to complete a new order without needing to re-enter the information each time for a new order.
If a customer refuses to provide this information, Mondizen cannot prepare an invoice or deliver the order, and the sale will be cancelled.
Mondizen collects this customer information using the web browser's cookies.
In accordance with the French law regarding information and freedom (Loi Informatique et Libertés), the processing of customer personal information must be declared to the CNIL (Commission Nationale Informatique et Liberté, the national commission for information and freedom). In addition, in accordance with Article 34 of that law established on 6 January 1978, the customer retains a right of access, modification, correction and deletion of this information upon a simple request made to Mondizen either by email via the link "Contact us", or by slow mail addressed to the Mondizen headquarters.
Mondizen will not share a customer's personal information with any third parties.
The details of the customer's method of payment are not recorded by Mondizen.
To comply with Article 1348 of the Code Civil, Mondizen records and archives orders and invoices in a reliable and durable medium. These copies are considered to be proof of the completed transactions and communication between the parties in the case of any legal procedures.
The "Tribunal de Commerce de Vienne (38)" is the only competent court applicable in the case of any future legal procedure.
